Daffodilian Getaways – Independent Travel Agent Terms, Policies & Privacy

Effective Date: January 15, 2026

This document (“Policy”) sets forth the Terms & Conditions, Company Policies, Commission Structure, and Privacy Rules governing all Independent Travel Agents affiliated with Daffodilian Getaways.

This Policy applies to all Independent Agents and operates alongside the Independent Travel Agent Agreement and Agent Handbook. In the event of conflict, the Agreement shall prevail.

1. Definitions

Company / Host Agency: Daffodilian Getaways
Agent: Independent Travel Agent affiliated with the Company
Flight Provider: Airnets International
Portal: Daffodilian Getaways Agent System
Rolling 12-Month Sales: Total confirmed sales generated by an Agent within the preceding twelve (12) months, excluding cancellations, refunds, or chargebacks

2. Acceptance of Terms

By accessing the Portal, submitting bookings, or operating as an Independent Agent under Daffodilian Getaways, the Agent confirms acceptance of:

Failure to comply may result in suspension or termination.

3. Independent Agency Structure

3.1 Agents operate as independent contractors, not employees.

3.2 No salary, benefits, guaranteed income, or employment relationship is created.

3.3 Agents may operate under their own business name, provided they clearly disclose affiliation as:“Independent Travel Agent affiliated with Daffodilian Getaways.”

3.4 The Company retains administrative oversight, visibility, and audit rights over all bookings.

4. Booking Authority & Restrictions

4.1 Flight Bookings

Agents are authorized to book flights exclusively through Airnets International.
All flight bookings must be processed via the Company’s Portal.
Booking flights outside Airnets International under the Company’s name is strictly prohibited.

4.2 Hotels, Tours & Other Travel Services

Hotel bookings, tours, cruises, and other travel services are handled exclusively by the Company.
Agents do not have access to the Company’s private supplier accounts for these services.
Agents must coordinate with the Company for non-flight travel components.

5. Commission Structure (Rolling 12-Month Sales)

Commissions are calculated based on the Agent’s Rolling 12-Month Sales, determined at the time supplier commission is received.

Rolling 12-Month Sales

$0 – $4,999

Agent Commission= 60%
Company Share= 40%

$5,000 – $14,999

Agent Commission= 65%
Company Share= 35%

$15,000 – $44,999

Agent Commission= 70%
Company Share= 30%

$45,000 and above

Agent Commission= 80%
Company Share= 20%

Commission tiers are not permanent and must be maintained through continued sales activity.

If sales decline, commission levels may adjust accordingly.

6. Commission Eligibility & Payment Timing

6.1 Commissions are earned only after supplier commission is received by the Company.

6.2 No commission is earned on:

Canceled bookings
Refunded bookings
Chargebacks
Fraudulent or disputed transactions
No-shows

6.3 Commission payments are processed monthly, subject to verification.

7. Cancellations, Refunds & Chargebacks

If a booking is refunded or canceled, the associated commission is fully reversed.
If commission has already been paid:
The amount will be deducted from future commissions, or
The Agent must repay the commission upon request.
This policy reflects standard travel industry practice.

8. Client Ownership

8.1 All clients, booking records, and transactional data are the property of Daffodilian Getaways.

8.2 Agents retain access to client information only while actively affiliated with the Company.

8.3 Upon termination or inactivity, client access may be revoked without notice.

9. Minimum Activity Requirement

To remain active, Agents must meet at least one of the following:

One (1) confirmed booking within a three (3) month period, or
Minimum annual sales of $10,000
Inactive Agents may be deactivated at the Company’s discretion.

10. Confidentiality & Non-Disclosure

10.1 All internal systems, supplier access, pricing, workflows, and data are confidential.

10.2 Agents may not disclose, share, copy, or misuse confidential information.

10.3 Confidentiality obligations survive termination indefinitely.

11. Privacy & Data Protection

11.1 Personal data is collected solely for:

Booking travel services

Commission processing

Legal compliance and support

11.2 Data may include personal details, travel documents, and payment authorizations.

11.3 Agents may access data only for legitimate booking purposes.

11.4 Unauthorized use, storage, or sharing of data is strictly prohibited.

12. Branding & Marketing Policy

Agents may:

Use their own business name
Market services truthfully
State affiliation with Daffodilian Getaways

Agents may not:

Claim airline accreditation
Misrepresent pricing or discounts
Misuse Company branding or logos
Accept off-platform payments

13. Compliance, Monitoring & Audits

13.1 The Company may audit bookings, communications, and transactions.

13.2 Agents must cooperate fully with compliance reviews.

13.3 Non-compliance may result in:

Commission holds
Suspension
Termination

14. Suspension & Termination

14.1 Grounds for termination include:

Fraud or misrepresentation
Breach of confidentiality
Repeated negligence or errors
Violation of airline or supplier rules

14.2 Upon termination:

Portal access is revoked
Outstanding commissions may be reviewed or withheld
No commissions are payable on future travel
Fees (if any) are non-refundable

15. Limitation of Liability

The Company is not liable for:

Airline schedule changes
Supplier failures
Acts beyond reasonable control
Agents agree to indemnify the Company for losses caused by Agent misconduct.

16. Policy Updates

Daffodilian Getaways reserves the right to update this Policy at any time. Continued participation constitutes acceptance of revisions.

17. Governing Law

This Policy is governed by the laws of Canada, unless otherwise required by jurisdiction.

18. Acknowledgement

By operating as an Independent Travel Agent affiliated with Daffodilian Getaways, you confirm that you have read, understood, and agreed to these Terms, Policies, and Privacy Rules.
