Daffodilian Getaways – Terms & Conditions

Welcome to Daffodilian Getaways, a travel agency. These Terms and Conditions (“Terms”) govern your access to and use of our website and travel booking services (collectively, the “Services”). By visiting our website, making a booking, or otherwise using our Services, you (“User”, “you”, or “your”) agree to these Terms in full. If you do not agree with any part of these Terms, please do not use our Services.

1. Definitions

Travel Agency: Daffodilian Getaways, a travel agency operating as a separate legal business entity.
Services: Travel booking, reservation, and ancillary services offered by Daffodilian Getaways through our website or other platforms.
User: An individual or entity accessing or using our website or booking any travel arrangements.
Bookings: Any travel-related reservations made through our Services, including flights, accommodations, tours, or other travel-related services.
Content: Any text, graphics, images, or other information provided by Daffodilian Getaways on its website.

2. Acceptance of Terms

By accessing our website or using our Services, you agree to comply with and be legally bound by these Terms, including any future modifications. Continued use constitutes acceptance of these Terms.

3. Services & Bookings

Business Ownership & Role: Daffodilian Getaways is an independently owned travel agency. The business owner operates and manages the Services offered under this brand. While we facilitate bookings and payments, we act as an intermediary between Customers and third-party travel suppliers.
Scope of Services:

We act as an intermediary between you and third-party travel providers (airlines, hotels, tour operators, etc.).

We strive to provide accurate information; however, final confirmation, pricing, and availability are determined by the suppliers.

Booking Process:

To complete a booking, you must provide accurate personal details and valid payment information.

Bookings are confirmed once payment is received via Stripe, Affirm, Klarna, or in-house financing and acknowledged by us or the supplier.

Special Requests:

Requests for meals, seating, room type, or other preferences are not guaranteed and are subject to supplier availability.

4. Payment, Pricing & Refunds

Payment Terms: Payments are collected via Stripe or financing options. By booking, you authorize Daffodilian Getaways to process your payment and pay suppliers on your behalf.
Pricing: Prices are subject to change until full payment is received and the booking is confirmed. Taxes, fees, and surcharges may apply.
Fees:

Standard card payments: 2.9% + $0.30 per transaction.

Affirm / Klarna payments: 6% + $0.30 per transaction.

In-house financing: 10%–20% booking fee plus an additional $100–$500, depending on approval and total trip cost.

Additional service or processing fees are disclosed at checkout or in the Fees Schedule.

Non-Refundable Payments: Payments are non-refundable unless the supplier permits a refund.
Refunds: Refunds allowed by suppliers are processed according to their policies, minus applicable service or processing fees.
Additional Charges: Any charges for cancellations, changes, upgrades, or penalties imposed by suppliers are your responsibility.

5. Cancellations & Modifications

User-Initiated Changes: Requests for cancellations or modifications must be submitted in writing. Supplier fees for changes or cancellations apply.
Provider Cancellations: We are not responsible for cancellations or changes made directly by suppliers but will assist with communication where possible.
Force Majeure: We are not liable for failures caused by events beyond our control, including natural disasters, political instability, strikes, pandemics, or other unforeseen circumstances.

6. User Obligations

Provide complete and accurate information.
Comply with all travel requirements (passports, visas, insurance, vaccinations, and other entry conditions).
Maintain account security if an account is created.

7. Intellectual Property

All content, trademarks, and intellectual property belong to Daffodilian Getaways or its licensors. Content may be used for personal purposes only. Reproduction, distribution, or exploitation without prior written consent is prohibited.

8. Limitation of Liability

No Guarantee: We aim to provide accurate information but do not guarantee completeness, accuracy, or timeliness.
Liability Cap: Our liability is limited to the amount paid by you for the specific booking.
Third-Party Services: We are not responsible for services or practices of third-party suppliers.

9. Privacy & Data Protection

Personal information is used solely to process bookings, communicate with you, and fulfill travel arrangements.
Payments are processed securely via Stripe, Affirm, Klarna, or in-house financing. Daffodilian Getaways does not store full credit card numbers.
We do not sell, rent, or disclose your data to unrelated third parties.
For in-house financing, financial information is collected for verification, approval, and payment processing.

10. Changes to the Terms

We may modify these Terms at any time. Updates take effect immediately upon posting. Continued use of our Services constitutes acceptance of revised Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of Alberta, Canada. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Alberta, Canada.

12. Indemnification

You agree to indemnify and hold harmless Daffodilian Getaways, its affiliates, employees, and agents against claims, damages, losses, or expenses arising from your use of our Services or breach of these Terms.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect and be interpreted to reflect the original intent.
